Interim Measures of Beijing Municipality on Promoting Overseas Students to Start Business and Work in Beijing

  Article 1 The term "overseas students" as mentioned in these Measures refers to those who have studied abroad for more than one year and have recently returned to China, and meet one of the following conditions:
  (1) Having obtained a master’s degree or above abroad or having graduated from abroad;
  (2) Having held intermediate or above professional and technical positions before going abroad;
  (3) Having obtained a doctorate before going abroad, and going abroad for postdoctoral research or further study.
  Article 2 Principles to be followed in promoting overseas students to start businesses and work in Beijing:
  (1) The principle that the Party manages talents. Form a unified leadership of the party Committee, the organization department takes the lead in grasping the overall situation, the relevant departments are responsible for their own duties, and social forces participate extensively.
  (2) The principle of highlighting key points. Focusing on the needs of building a "humanistic Beijing, a high-tech Beijing and a green Beijing", we will strive to introduce outstanding overseas students with real talents and development potential.
  (3) The principle of market allocation. The government provides public services, and overseas students come to Beijing to start businesses and work according to the principle of two-way choice.
  (four) the principle of the introduction of the employer. The employer shall introduce as needed, and provide the necessary career platform and conditions.
  Article 3 Overseas students can consult and learn about Beijing’s entrepreneurial and working environment, relevant policies, work information, job requirements and life information through the reception service window of Beijing Overseas Scholars Center, the website of Beijing Overseas Scholars and the hotline for overseas students to start businesses and work in Beijing.
  Relevant departments of the city regularly hold activities such as "Overseas Talent Development Forum", "Talent Technology Exchange and Project Promotion Fair" and "Overseas Scholars See Beijing" to provide opportunities for overseas students to realize the docking of talents, technologies, projects and capital.
  Article 4 Overseas students are not limited by their domicile before going abroad, but apply to Beijing Overseas Scholars Center with the certificate of the employer or business license, and receive the Beijing Work Residence Permit (for overseas students) after being audited by the Municipal Human Resources and Social Security Bureau.
  Article 5 The main ways for overseas students to start businesses and work in Beijing are:
  (a) the establishment of enterprises in the form of technology shares or investment;
  (2) Establishing and leasing various economic entities and research and development institutions;
  (three) to work in state-owned enterprises, institutions and other types of economic and social organizations;
  (four) to carry out academic exchanges and scientific research cooperation or undertake scientific research projects;
  (five) to enter the postdoctoral research mobile station and workstation to engage in postdoctoral research;
  (six) to work in public welfare institutions such as community public services;
  (seven) to enter the city, district and county state organs as civil servants.
  Article 6 Overseas students who come to Beijing to start enterprises can register directly with their passports, and the registered capital can be implemented according to the minimum standards stipulated by relevant state laws and regulations. Those who have passed the evaluation of Beijing Overseas Scholars Center will be provided with 100,000 yuan of enterprise start-up expenses by the government. Give priority to those who apply for all kinds of small and medium-sized enterprises’ entrepreneurial guidance funds set up by the municipal, district and county governments; If a bank loan is obtained, the government will give some or all discount support. Those who establish high-tech enterprises can enjoy preferential policies for high-tech enterprises in this Municipality.
  Article 7 Support high-tech industrial development zones, science and technology business incubators, overseas students’ pioneer parks, university science parks, industrial parks and other parks to establish venture capital and credit guarantee funds, and provide venture capital support and financing guarantee services for overseas students.
  Eighth to encourage all kinds of financial institutions, domestic and foreign venture capital funds, private capital, etc. in accordance with the relevant provisions of the state and this Municipality, set up venture capital funds for overseas students to provide financial support for overseas students to start their own businesses.
  Article 9 The income earned by overseas students who come to Beijing to start businesses and work, engage in technology transfer, technology development business and related technical consultation and technical services may be exempted from business tax upon confirmation by relevant departments; After paying taxes in accordance with the law and issuing special vouchers after examination and approval by the tax authorities, all the legal income obtained from starting a business can be purchased and taken abroad or remitted abroad.
  Article 10 If overseas students come to Beijing to set up enterprises, the development direction of the enterprises conforms to the orientation of the capital’s industrial development, and the average annual tax payment in recent three years has reached more than 1 million yuan, and it is necessary to introduce the backbone of foreign technology research and development and management, they will be given preferential treatment in terms of scientific research incubation, financial support and talent introduction.
  Eleventh to encourage the laboratories of municipal institutions of higher learning and scientific research institutions to open to enterprises founded by overseas students. Enterprises that support overseas students to set up their own business or jointly set up enterprise technology centers and engineering technology research centers with universities and research institutes will be given one-time financial support and enjoy relevant preferential policies if they pass the national or municipal review and acceptance.
  Article 12 Overseas students who come to Beijing to develop and produce high-tech projects and products may apply for relevant scientific and technological support from the Municipal Science and Technology Commission in accordance with relevant regulations, and give priority support under the same conditions.
  Article 13 If overseas students come to Beijing to conduct scientific research, engage in technological transformation projects, research projects with patents and inventions, and develop new products and technologies, the employer shall provide them with necessary conditions such as experimental sites and equipment, provide necessary financial support, and allow them to hire assistants at home and abroad. Overseas students engaged in scientific research activities can apply to the Municipal Science and Technology Commission for scientific and technological funding support.
  Fourteenth overseas students who are employed in scientific research, teaching, health and other institutions or enterprises in this city to hold professional and technical positions are not limited by the establishment of the unit and the index of professional titles. Overseas students who have not obtained professional and technical titles abroad shall be directly determined by the Municipal Human Resources and Social Security Bureau according to their overseas experience and knowledge level.
  Fifteenth to protect the legitimate rights and interests of overseas students, in accordance with the provisions of relevant laws and regulations, to protect the intellectual achievements, legitimate income and other rights and interests of overseas students in Beijing.
  Sixteenth enterprises and institutions in this Municipality employ overseas students, and their remuneration shall be determined by the employing unit in consultation with themselves. If an enterprise is employed, it can set its own wage standard according to the situation; Those employed by public institutions can be determined according to the preference of similar personnel in their own units, and those who have made outstanding contributions can be rewarded upon approval.
  Article 17 Overseas students with foreign passports (including spouses and minor children) may apply to the public security organs for a two-year residence permit for foreigners or a one-year multiple-entry visa (not exceeding the validity period of the passport) with the relevant certificates such as the Beijing Work Residence Permit for Overseas Students. If you can’t leave Beijing on schedule for a short period of time, you can apply for a visa extension. If it is true that the entry visa has not been completed abroad due to time constraints or other reasons, you can apply for a port visa in accordance with relevant regulations.
  Article 18 Overseas students who come to Beijing with China passports to start businesses and work, who have obtained the Beijing Work Residence Permit for Overseas Students, have a master’s degree or above, or have a senior title before going abroad, shall be transferred to Beijing by the Municipal Human Resources and Social Security Bureau upon the application of the employer, and their spouses and children under the age of 18 may move with them according to relevant regulations.
  Nineteenth overseas students who come to Beijing to start a business and work, and go abroad to work, study, study or participate in relevant academic activities again, simplify the relevant procedures.
  Article 20 For overseas students who come to Beijing to start a business or work, the education administrative department of the district or county where they live shall arrange for their children to enter the nursery and compulsory education stage, and handle the admission and transfer procedures for them, without charging fees other than those stipulated by the government; To participate in the national unified examination for graduate students, colleges and universities in this city can give priority to admission under the same conditions.
  Article 21 Conditional hospitals are encouraged to cooperate with domestic and foreign insurance companies in commercial medical insurance to facilitate overseas students to seek medical treatment in Beijing.
  Twenty-second overseas students can participate in social insurance according to the provisions of this Municipality. The length of service of overseas students before going abroad, during their stay abroad and after returning to China, which can be calculated continuously according to the relevant provisions of the state, should be calculated continuously and combined with the social insurance payment period.
  Twenty-third overseas students who come to Beijing to start a business or work may apply for renting short-term revolving residence provided by Beijing Overseas Scholars Center at preferential prices, or the employer may provide housing in the form of contract.
  Article 24. Students studying abroad may stay abroad for no more than two years from the date of graduation, and may apply to the customs for a duty-free domestic car within one year from the date of first entry after graduation.
  Twenty-fifth overseas students who have made outstanding contributions to the city, who meet the selection conditions, can declare "Outstanding Talents Award in Capital" and "Entrepreneurship Award for Overseas Students in Beijing" and other commendation awards. Winners can give priority to recommending and declaring scientific and technological progress awards and other awards according to regulations.
  Article 26 The Beijing Overseas Scholars Center shall establish an information database of overseas scholars and an information database of key middle school students studying abroad to realize resource sharing and provide support for talent selection.
  Twenty-seventh employers should continuously improve the talent team structure and actively introduce overseas students according to the needs of career development; We should sign employment (labor) contracts with imported overseas students in accordance with national laws and regulations, clarify the rights and obligations of both parties, and provide working conditions and platforms; We should care about the thoughts and life of overseas students and actively coordinate and solve specific problems in their work and life.
  Twenty-eighth these measures shall come into force as of the date of promulgation, and the relevant issues involved in the implementation process shall be coordinated and solved by the office of the Municipal Leading Group for Talent Work. The notice of the Beijing Municipal People’s Government on printing and distributing some provisions of Beijing Municipality on encouraging overseas students to start businesses in Beijing (Beijing Zhengfa [2000] No.19) previously issued shall be abolished at the same time.
